CCM Recovery Process
1) The recovery process begins with the receipt of the file:
- Electronic Files
- Paper Files
2) File Review and Verification:
- Credit Bureau report review
- Bankruptcy screening
- Statute of limitation review
- Documentation review
- Counterclaim review
- Balance verification
- Proper venue verification
- Proper plaintiff verification
- Defendant’s location verified
3) A file is not suit worthy if it has:
- Legal limitations
- Credit limitations
- Documentation limitations
- Bankruptcy
- Statute of limitations
- No capacity to repay
- Poor or inadequate documentation
*A file that is not suit worthy is returned or becomes an agency placement.
4) The process for a suit worthy file begins with:
- Plaintiff Demand
- Formal demand letter
- Telephone contact
5) Establish Voluntary Payment Plan:
- Evidenced by:
- Confession judgment - pre-suit
- Stipulation for judgment
- Appropriate documentation for venue
*If a voluntary payment plan defaults, the plan becomes a judgment and the file proceeds to the execution stage.
6) Summons and Complaint:
- Prepare and file summons and complaint
- Serve defendant
- If defendant files an answer to a complaint
- Prepare and file default judgment
- File and record judgment
- Prepare and file discovery
- Or summary judgment motions
- Set for trial
*Once a judgment is obtained the file proceeds to the execution stage.
7) Execution Stage:
- Garnish bank account, where permitted
- Garnish wages – all defendants, where permitted
- Attach personal property, where permitted
- Execute on real property, where permitted
8) If the defendant skips to avoid the judgment and execution::
- The judgment file follows the defendant to their new venue
- The judgment is domesticated and recorded in the new venue
- The execution continues
